Recently Mr Marlon Shevelew Senior Attorney, of Marlon Shevelew and Associates Attorneys at Law, launched a new service which is ground breaking for Estate Agents who are involved in managing the rentals of residential and commercial property.
For a small monthly fee of R350-00 (three hundred & fifty Rand) per month plus Vat an agent is entitle to 1 (one) hours of time to ask questions, seek advice, by phone, fax, email or SMS of the best attorney Marlon Shevelew that I know in regards to the law governing rentals.
This is great values when you consider the fees that an attorney ask for a normal consultation, that can set you back as much as R800-00 + per hour, only to learn that the attorney does not know much about rentals, and the law.

The final chapter in the story of Grace Nienaber:
Be warned this is a non paying person who will sit in your office straight face and lie, to you and to her attorney and anyone else in the room.
After a long battle, starting with Grace Nienaber having a number of make believe attorneys contact us and the debit collectors she is out at the end of October.
Part of the process:
Granted an attachment order, the sheriff of the court did the attachment but did not remover? Why? The sheriff wanted a guarantee against being sued by Grace Nienaber.
Eventual after a month a new sheriff was appointed and the attachment was done again, but not removed, why the old order had expired, so a new order was given, and attachment and removal was done, by this time, Grace Nienaber had had enough warning that we were going to succeed with attachment and removal that she had removed most of the good furniture.
I will not bore you with all the details of what went on.
After getting the house back from Grace Nienaber it was found that door handles had been removed locks interfered with and the house left in a mess.
Grace Nienaber removed the locks to stop entry by the sheriff, this is a woman who is well conversed with the process of attachment.
After the attachment and removal Grace Nienaber went to court for with a urgent application to get her property back from the sheriff, this was apposed and successful, this was being done without notice to us, just that we were informed by the court of the application and given time to oppose.
Her daughter from overseas has made a down payment on a R100,000 + account, and has made arrangements to pay off the account. Will it be paid off fully I don’t know.
My most serious advice to owners, do your home work, get a good agent who knows the law and has been doing rentals for at least 5 years, has a Fidelity Fund Certificate, uses TPN, has a NQF4 and is part of the IEASA.
Some pointers for renting:
1. Screening your tenant with TPN
2. Get it all in writing.
3. Handle the deposit correctly.
4. Make repairs timeously.
5. Make sure the premises is secure.
6. Provide notice to tenant before entering.
7. Chose your rental agent wisely, ask for at least 3 CV.
8. Check your building insurance.
9. Resolve disputes without having to go the legal way or to the Western Cape Rental Housing Tribunal.
10. Make it a rule, no deposit, no rent paid in full, NO KEYS, don’t even turn up for the incoming till the money reflects in your account. NO MONEY NO KEYS.
11. Do a incoming inspection jointly and record, use lots of photos.
12. Do pre-outgoing and outgoing inspections.

Warning to all estate agents and property sellers. Lance and Stacey Hockly misled us by submitting an offer to purchase December 2010 for our property in Benoni. They could not apply for a bond immediately and wanted to rent for three months. They asked for a reduced rent, no deposit and the first month rent free as they were purchasing the property.The three months turned to six months, which became eighteen months, with many excuses as to why the sale could not be finalized.
In March 2012 we gave them a final deadline and increased the rent in June and placed the property on the market. The tenants (Hockly’s) gave notice and moved out at the end of August, however owe us the increased rental since June and did not pay the August rental. They have left us with a hefty electricity bill too. Fortunately our home has been sold to serious buyers without any problems.
The Hockly’s are relocating to Pietermaritzburg in November and are planning to PURCHASE a home there.
…Leaving many unpaid bills behind them, including Stacey Hockly not paying for renting my dance studio (November) and I know of one other longstanding unpaid debt.
The continuing story of Grace Nienaber, after having got Grace and her son out of the last property they went and moved into a private owners home.
The owner was in a hurry, and did not take his normal precautions and allowed Grace to move in with no deposit and no rent, only with a promises that it would be paid on Monday, the problem is that Grace forgot to mention which Monday.
It is now 6 weeks since she took occupation, and 5 weeks since I became involved in assisting the owner to get her out.
Grace is an old hand at this and knows all the ropes to pull to delay any action on her.
Grace has had an attorney involved who stated that money would be paid on a certain date and that has come and gone, then other dates were offered and they have come and gone, the attorney has since given notice that they no longer represent Grace.
Her latest efforts has been to have a mediator who pass himself off as an attorney, and when it came to mediating in my office on Wednesday 8th August 2012, which was recorded, did state that he is not an attorney and not sitting on the bench.
At the mediation she stated which is recorded, that the money has been paid some R30,500-00 into the debt collectors bank account and that she would produce proof before close of business on the same day.
You have guessed it, no proof and no money. I will not disclose just now what action is under way but I will post it after the action has happened.
Warn all your friends not to believe her or her son, give them a sheet of black plastic and the can go and join the squatters and make a shack from themselves.
I have meet people in Botswana who have nothing with more honesty and integrity than what this woman has.
Just to share with every one, I had a tenant who was a tenant with me in 2009 and I assisted her to find a house to purchase.
The tenant became a owner, and it is interesting that she would have no one else but Landlords manage her property for her, she stated that we were tough on her, and she hated us for being so tuff, but when it comes to managing her own property she knows that we will look after her and the tenant.
It has to also be remembered that in the complex there is an attorney firm operating as rental agents as well, and the owner would not go to them, because of our track record with her.
My advice to all agents is do it right and stick to the rules and the law, you will come into conflict but it is worth it.
I have had this happen to me many times in the years I have been running the company and doing rentals, tenants hate me, but they know that we treat them fair, and we do it by the book.

Be WARNED, that Mr. Wessel Lourens Nienaber 5 Vierlanden, working at Bloemendal, rents a property in his own name, as his mother Grace Nienaber cannot, her name is so bad that she cannot get credit anywhere.
Grace Nienaber is a liar, a cheat and feels nothing for any one, she is a con, and never to be trusted, do not allow her anywhere money, when employing this person, or her son Wessel Lourens, you will get your fingers burnt.
Never rent to eight of them, let them get a sheet of plastic to live under, they have hurt a lot of people by their actions.

A R Van Vuuren rented 59 Bishops Court Crescent, Bishops Court, Stellendale Village, Kuils River 7580 form me, he paid rent then left his wife in the house to battle on her own with children, two girls and a son, rent was not paid, and water was not paid, the wife was convinced to vacate without an eviction order having to be obtained for her, it was not a nice situation as it was beyond her control.
A R Van Vuuren still owes R10,925-90 in outstanding rent and water charges.
Terence Sean Pietersen and Sheila Margaret Pietersen rented 59 Bishops Court from me, and paid by cheque, which bounced right through the ceiling, and then ran away after a month because we made it too hot for them.
Now they are ripping someone else off. Do not rent to them.
I have meet many tenants in my 40 odd years that I have rented out properties, and many liars, and Mr. Wessel Lourens Nienaber is added to the list, this weekend he is vacating, from 5 Vierlanden, the problem is that this free loader who works at Bloemendal is going to go and catch another owner and not pay his rent, so he thinks, I have put the debit collectors onto him and the Housing Tribunal.
He even had his mother call me and tell me that she has paid three months’ rent 2 for the months that she owes for, and 1 month in advance, I am still waiting for the money to come through as it was just one more of their lie’s.
What he does not realise is that he is Black Lister on Tenant Profile Network and that if he goes to any affiliate company of TPN he will not get a place to rent, and I will get message to say where he is living and will zoom in on him again.
Do not take them as tenants, let them go and live under a sheet of plastic or at a bus stop, they do not deserve a good place to live.
Beware of non paying tenants in the Sandton/Rivonia area. They have a load of excuses for non payment and refuse to move out. Max Michael Sipser and May Sipser and their daughter Bridgette Isaacson. Beware- many lessors have been conned!
My Brother was caught by the same people in their scam- seems as though they take out a lease and string the landlord along for a few months using any story they can think of, then do a midnight runner.
